Is an IID Mandatory After a First DUI?

Not always - but often. Under Florida Statute 316.1937, an ignition interlock is mandatory for at least 6 months on a first conviction if your BAC was 0.15 or higher, or if a minor was in the vehicle. For a first DUI below 0.15, the judge may order an IID for up to 6 months - and many do.

If you want a hardship license to keep driving for work or school, installing an IID is typically part of the deal regardless.

The Full First-DUI IID Checklist

Here's what the process usually looks like, in order:

1. Court disposition - your judgment states whether an IID is required and for how long
2. DUI program enrollment - Florida requires completion of a state-approved DUI program before reinstatement
3. FLHSMV paperwork - proof of DUI program enrollment, FR-44 insurance filing, and any hardship application
4. IID installation - at a state-approved service center; you receive an installation certificate
5. Report the installation - the certificate goes to the FLHSMV and/or the court to activate your driving privileges

How Long Will You Have It?

For a first offense, the typical range is up to 6 months - 6 months minimum when BAC was 0.15+ or a minor was present. What Counts as a Violation?

The device reports to the FLHSMV, and your requirement can be extended for:

• Failed startup tests above the set alcohol threshold
• Missed rolling retests while driving
• Missed calibration appointments (usually every 30 days)
• Tampering or circumvention attempts
